Workers compOmaha Workers’ Comp Lawyer: We Bring Results

Workers’ Comp Success Story

“Julie” is a registered nurse at an Omaha hospital. She suffered a significant injury to her hip  in 2018 while helping her patients. Her employer is self-insured. Julie sought our firm’s assistance in a workers’ comp claim. We filed a lawsuit.

Julie underwent surgery and recovered from her injury to the best of her ability. Still she had restrictions that would make it so that she can never work as a floor nurse again – or lift much more than 35 pounds.

Julie was assigned an impairment rating to her hip. The employer told her that they would pay her for her impairment rating, which came out to about $15,000. Julie didn’t think that it sounded right that she would never be able to work as a floor nurse again and only be paid such a small amount.

The hip is a part of the body which qualifies as a whole body injury. The deciding factor in Nebraska workers’ comp law whether a person gets an impairment rating, or a loss of earning capacity is where the restrictions from the injury actually reside in the body.

After obtaining her medical records and fighting through the discovery process we were able to convince the insurance companies’ lawyer to settle her workers’ comp case for $100,000.  During that time, Julie also found a new job as a nurse but working in a different capacity. Although she is no longer able to be a floor nurse, she can still work as a nurse – just in a different capacity.

Our firm never took a dime of her $15,000. We wanted to help. And we did. Our attorneys can help you, too.
